This disclaimer regulates the use of the services and contents that Hidroeléctrica del Cantábrico, S.A., hereinafter HC ENERGÍA, whose registered office is at Plaza de la Gesta, 2, Oviedo 33007, with Tax Number B33473752, entered in the Asturias Trade Registry in Volume 2907, Book 0, Folio 192, Section 8, Page AS14614, Entry 32, makes available through the www.edpenergia.es, URL, hereinafter “the web” or “the website”.

Terms and Conditions of Access and Use

EDP makes the www.edpenergia.es website available to Internet users in order to provide information and showcase the activities, products and services provided by the EDP Group. The users may access the website free of charge, even though some of the website contents and services may require the prior registration of the user pursuant to what is established in its Specific Conditions.

Access and/or use of the www.edpenergia.es website attributes the status of User to the person doing so and implies unreserved, full and express acceptance of each and every one of the provisions included in the conditions, warnings and other legal disclaimers contained herein, as well as, where applicable, in the Specific Conditions that may complement, replace or amend them in any way in relation to the services and contents of the website. Therefore, you as the user should carefully and closely read this document in full at the time you plan to use the website as it may be amended.

EDP hereby reserves the right to update, amend, temporarily suspend, eliminate or restrict the contents and configuration of the website at any given moment, along with the links or the information obtained through them without any need for prior notice and without assuming any ensuing liability.

The User is required to use the services and contents pursuant to current legislation and the principles of good faith and generally accepted good practice, as well as not to act in such a way through the website as to breach public order and in particularly not to infringe or undermine fundamental rights and public freedoms recognised constitutionally and in other legislation. ESP accepts no liability regarding any misuse of the information and/or services facilitated through the website and the user who access them or uses them improperly shall be solely liable.

Protection of Personal Data

Visiting this website does not require the user to provide any information on themselves. However, in order to use some of the services or access certain contents, the users shall provide certain personal data beforehand. Should you provide any personal information, the data gathered in this website will be processed by companies of the EDP Group responsible for the files (with Group being taken to mean what is envisaged in Article 4 of the Securities market Act) as indicated in each case, required to process and monitor the requests and queries made through the website, along with managing and providing the complementary review services and technical assistance, and participation in promotion, draws, competitions or surveys, which shall be duly notified at the time of collecting your personal data and your consent request should it be necessary pursuant to what is established in the Personal Data Protection Act 15/1999, of 13 December, (hereinafter LOPD) and its enactment regulations.

The company responsible for the file shall only disclose your data when necessary for the development, compliance and control of the relationship established with the user, as well as in the legally envisaged circumstances pursuant to LOPD, pursuant to the information provided when gathering your personal data. Security measures

Pursuant to Heading VIII of Royal Degree 1720/2007, of 21 December, which approved the regulations enacting the LOPD, EDP hereby undertakes to comply with the security obligations for those data provided by users of the website, and shall endeavour to establish all the technical measures in its reach to avoid the loss, misuse, altering, non-authorised access and theft of the data that the user provides through the website. Notwithstanding the above, the User should be aware that online security measures are not impregnable.

Industrial and intellectual property

This website is the property of EDP. The user acknowledges and accepts that all the industrial and intellectual property rights regarding contents and/or any other elements inserted in the website (including but not limited to brands, logos, trade names, texts, images, graphics, signs, software, etc.) are the property of EDP, except when it is indicated that they belong to another owner. The logos or distinguishing signs of the other companies belonging to the EDP Group that may appear on this website are the property of each of them.

Downloading the contents and copying or printing any page of this website is solely and exclusively authorised for the private and personal use of the user, who may not reproduce, distribute, transmit, translate or amend totally or partially or use the contents of this website in any form or by any means for commercial or public purposes, even if the sources are cited, without the express consent of EDP. Any breach of these rights may lead to out-of-court or legal proceedings as applicable. Exclusion of warranties and liabilities regarding the operating of the website and its services

The use of the website is under the exclusive responsibility of the user and EDP shall never be held liable for any damage that may occur to the computer system arising from the access, use or misuse of the website contents, from the information acquired through the site, from computer viruses, from operating failures or interruptions to the service or transmission.

Jurisdiction and applicable legislation

These General Terms and Conditions of Use shall be governed by Spanish legislation.

EDP and the user hereby agree that they shall submit any disputes arising from the contents of the website and regarding the application and compliance of what is established herein to the jurisdiction of the Courts and Tribunals of the domicile of the User. Should the User be resident outside Spanish Territory, EDP and the User hereby agree to submit any dispute to the Courts and Tribunals of Oviedo and/or Bilbao and waive any other jurisdiction to which they may be entitled.
